    Hi,

    I'm in trouble situation, maybe somebody can give advice.
    I can file I-485(Eb3 March 2005). But my wife & daugther basically out of status. Their H4 visas were not extended.
    Before june bulletin I was thinking to go back home with my daughter (she is under 18) and try to get visa in consulate. It was attorney advice. Also he suggest to file for an asylym for my wife.
    Now I'm going to file I-485 for whole family regardless what attorney will tell me.
    Is it good idea to go directly to uscis office and ask them (can I file)?
    And what will happen if their apps gets denied?

    Any ideas?

    Call (in the morning) 1-800-375-5283 and follow this sequence: 1,2,2,6,1,1,1,3,4.

    If the Immigration Officer is kind enough you can ask if the Name Check is cleared. If he/she says No, you can ask him/her the date it was sent to the FBI.

    I called today and they couldnt tell me anything at the 800 number they just said that they would contact me if they needed any information.... guess I just sit tight for now!

    I have both I-94 attached to passport and also I-94 along with current I-797. I still confused which one to use?

    Technicaly you should possess only one I-94. So when USCIS asks for a copy you should submit only the latest. If you submit extra copies you will create more confusion why you possess more than one I-94. My advice just send them the one that is valid and latest. USCIS can determine you live in this country legally from your records including ur passport, I-797, I-20 past EADS etc.

    AP can be used to re-enter and you can continue on your H1 if it is valid. Your H1 is invalidated only if you use EAD.
    I just came back to US using AP, I had booked an appointment for Visa interview. But after seeing the PIMS mess I decided to use AP. It was very smooth and easy.


    A question though: is'nt it abandoning your H1B1 visa tenure if you enter on AP even with a valid H1B remaining?[/QUOTE]
    Well good for you that you could use AP. We had AP ourselves, but I wanted to use the remaining H1B period, hence the big mistake. Now the only way to use AP is to withdraw our visa applications, get the passports, and fly back. I will resort to this ifthe passports are not returned by the coming weekend. Chennai consulate sucks!!

    Can somebody please answer my question?? does anybody have experience filing the I-485 themselves instead of using a lawyer???

    also, what is advance parole?? and why it is needed?? Thanks

    Do I have to file I-485 though a lawyer or can I do it myself. I have an old I-485 form that my lawyer filled out and he sent me a copy of but he never filed it to immigration. Can I update that old form he gave me and file an updated I-485 myself without a lawyer??

    I didn't get the phone# for USCIS compaint dept. But some one(may be ashres11) posted one phone#18003238603 for DHS. I called that number and it turned out Inspector General office. As i reported earlier. He told me to call regular USCIS 800. I said it's useless. He took some note and asked to call this new number 877-246-8253.

    It is excellent idea to get citizenship before getting GC. Is it possible? Nothing wrong in trying. But main aim should be getting GC reform. Like this only everyone including IV started in 2005. In 2006 High skilled immigration groups including IV and Corporations lobbied for unlimited GC and unlimited H1b for masters in STEM from India and for all Master Degree from USA. After realizing the practical situation every year diluted the numbers and all of them lobbied for just recapture bill in 2008. Finally nothing was acheived in GC. You can try this idea also but better cautious that it should not impact GC reform.

    Why do you even need a GC, my friend. Stick with H1B visa. the only difference between GC and H1 is independence of employer and why do you even bother about it. You can always get a job where you want, buy a house now, sell it tomorrow, then after 6 years, go out for a year, come back on new H1.
    As I said, people here are highly motivated and do want to follow the rules and achieve bigger things in lives, creating value in the process. But not many are willing to wait for 5 more precious years, after your greencard takes 10 years. Or 15 years on GC and 5 years for Citizenship. Once you work very hard, then you tend to ask for the right fruit, not just take anything.And whatever the Citizenship requirements are.. they will be met while waiting for theis damn GC..
    I am just hitting at the attitude.. not person.. sorry...
    Assume your school makes your 4 year course extended to 6 years and in the process makes you do a lot more..What do you ask at the end of it. 4 year degree or a 4+2 year degree.. .something similar..

    I dont expect USCIS to get all emotional because of our flowers and issue an update to their updated bulletin saying they will now accept and issue green cards.
    The point is that we need to make awareness that there is a HUGE community that gets affected by every move they make and that we are an active and cohesive community and also to create awareness of this debacle.

    Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. Now stop making fools of yourself and get a life.

    That USCIS director gave a good answer. Is your pain more than those citizens of this country who gave their limbs and life for US?. :eek:

    BTW, i am one of the guys who couldn't file I-485 because of this fiasco. But i understand the reality.:)

    .... If there is any sequence after Approvals, expect it this way: CPO/approval ADIT/Welcome mail (mail), Post decision/ Last processing Action= this is the date they mail cards and check/hope to find cards in mail box in 3-4days (DON'T discard as they look so very ordinary envelope....)

    The percentage of people here are a very small percentage of that 25%.


    H1/L1 restrictions are not going to encourage american kids. It does not impact their thinking. Maths, science are tougher subjects for kids. Kids in India were pushed by their parents to study science in search for a good career. Kids here have a lot other avenues which are more attractive to a kid. Kids do not understand L1/H1. 90% of adult population here does not understand H1/L1. REstricting H1/L1 will not influence a kid to take up science and engineering.

    I have news for you (and the certitude with which you make your claims here are laughable). Computer science graduation rates in US went up this year by 6-8%, because the visa caps since 2003 remained at 65000 instead of 195000 creating some demand here. I personally know kids who wanted to go to Computer science, but went for other areas like health care because of the lack of offshoring/H1 etc. If the crooked Indian offshorers and fly-by-night operators are not driving down the wages, more americans will go to computer science, as they would go for a career as MD or Pharmacist or lawyer (almost all those careers need at least 6-8 years of college). They also know that professional associations like AMA or APhA wouldn't allow importing foreign workers by corporations/hospitals on a scale that H1-bs are imported in IT area

    Based on my experience, I wouldn't say that Indian kids have any special skills in maths or science compared to americans. Contrary to what you claim, people are aware of H1s and offshoring(may be so much on the exploitation of L1) as they talk to friends and family and guidance counselors at school. Most of the IT jobs were Indian H1-bs are employed doesn't even need computer science or engineering degree. Some of the best architects I have seen in IT didn't have a computer science major. A green-horn from TCS/INFY with a computer science degree and pretending to be an architect doesn't mean he is the best IT professional available in the market.

    It is not true. The orignal text in IMMIGRATION AND NATIONALITY ACT says "Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraph (1), to qualified immigrants who are members of the professions holding advanced degrees or their equivalent or who because of their exceptional ability in the sciences, arts, or business, will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States, an d whose services in the sciences, arts, professions, or business are sought by an employer in the United States.
    "

    The item mentioned above is for EB2, meaning any spill over to EB2 is from unused EB1.

    for EB3 the ACT mentions the following

    Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), to the following classes of aliens who are not described in paragraph (2):

    The meaning is EB3 gets all unused from EB1 and EB2... This is the catch, does this mean spillover from EB1 after EB2 catches up (or) spillover from EB1 even if EB2 is not current..

    If they have done spillover from EB1 to EB3, even when EB2 is not current...we can give this a try.

Says Stahl, "60 Minutes checked that and found a report issued by the U.S. Department of Health and Human Services, saying that 7,000 is the number of leprosy cases over the last 30 years, not the past three. The report also says that nobody knows how many of those cases involve illegal immigrants." (Emphasis ours). This exchange then ensues:

    "We went to try and check that number, 7,000. We can't...," Stahl says.
    "Well, I can tell you this. If we reported it, it's a fact," Dobbs replies.

    "You can't tell me that. You did report it," Stahl says.
